Terms & Conditions of Sale
Hogs Back Logs | EST. 2005
Operated by R J Simmons Agricultural Services Limited, trading as Hogs Back Logs.
These Terms & Conditions apply to purchases made from Hogs Back Logs through our website, by telephone or through other direct sales channels, subject to applicable consumer law.
By placing an order, customers agree to these terms, which do not affect their statutory rights.
1. Products
Hogs Back Logs supplies firewood, kindling, firelighters, smokeless fuel and related products.
We aim to ensure that all product descriptions, measurements, prices and photographs accurately represent the goods supplied.
Firewood is a natural product, and variations in appearance, shape, bark and grain should be expected.
2. Prices and Payment
All prices displayed to retail customers include VAT at the applicable rate unless clearly stated otherwise.
Any additional delivery charges will be displayed before checkout.
Payment must be received or otherwise agreed before goods are dispatched or delivered.
3. Local Loose Firewood Deliveries
Local loose firewood deliveries are available only within our designated delivery area.
Our standard loose firewood quantities are:
-
Single Load: 1.2 cubic metres
-
Double Load: 2.4 cubic metres
These quantities represent loose-filled firewood volume rather than solid timber volume.
Firewood is delivered loose and tipped from our delivery vehicles.
Customers must ensure that the delivery location is reasonably accessible and suitable for a tipping vehicle.
Customers should notify us before delivery of any potential restrictions, including narrow entrances, low branches, steep gradients, soft ground, restricted turning space or other obstacles.
The driver has final discretion over whether a location is safe and suitable for tipping.
Where the requested location is unsuitable, the driver may offer an alternative safe and accessible tipping location.
Hogs Back Logs cannot guarantee that firewood will be tipped in a customer's preferred location.
Once delivery has been completed at the agreed location, customers are responsible for moving, stacking and storing their firewood.
4. Loose Firewood Delivery Cancellations
Once a delivery date has been confirmed, we kindly request at least 48 hours' notice for any cancellation or change of delivery date.
This allows us to manage our delivery schedule efficiently and offer available slots to other customers.
No cancellation penalty will be imposed where a customer is exercising their statutory cancellation rights.
5. Failed Loose Firewood Deliveries and Additional Charges
Where a loose firewood delivery or collection cannot be completed due to circumstances outside the control of Hogs Back Logs, including unsuitable access, undisclosed restrictions or the customer being unable to accept delivery, a reasonable additional charge may apply where legally permitted.
A charge of £50 may apply for an additional delivery or collection journey, provided this reflects reasonable costs incurred and the customer was informed of the applicable charge before ordering.
Alternatively, Hogs Back Logs may agree a suitable arrangement with the customer, including:
-
Rescheduling the delivery.
-
Arranging an alternative delivery location.
-
Agreeing a replacement or alternative product.
-
Another mutually agreed solution.
No additional charge will apply where the failed delivery or collection is the responsibility of Hogs Back Logs.
Any additional charges will be reasonable, proportionate and subject to applicable consumer law.
6. Nationwide Delivery Areas
Eligible products are available for nationwide delivery to the areas specified on their individual product pages.
Nationwide deliveries may be carried out by parcel courier or pallet delivery network, depending on the product ordered.
Delivery restrictions and postcode exclusions vary by product.
Customers are responsible for providing accurate delivery addresses and relevant access information.
7. Nationwide Courier & Pallet Deliveries
Pallet Deliveries
Pallet deliveries are kerbside only unless otherwise agreed.
The delivery driver determines a safe and suitable unloading location based on vehicle access, ground conditions and health and safety requirements.
Customers cannot require drivers to move pallets onto private driveways, across gravel or uneven surfaces, or into garages or buildings.
Hogs Back Logs cannot guarantee that pallets will be placed in a customer's preferred location.
Customers are responsible for moving and storing their goods after delivery has been properly completed.
Parcel Deliveries
Parcel deliveries are carried out by third-party courier companies.
The precise delivery location is subject to the courier's delivery procedures and any applicable delivery instructions.
Hogs Back Logs cannot guarantee that parcels will be left in a customer's preferred location.
Customers should ensure that delivery instructions and access details are accurate.
Delivery Locations & Responsibility
Hogs Back Logs is not responsible for moving or repositioning goods after they have been properly delivered to the agreed location.
Where a customer authorises a particular delivery arrangement, we will take those instructions into account, subject to the courier's procedures and applicable law.
Goods remain at Hogs Back Logs' risk until responsibility lawfully passes to the customer.
We remain responsible for resolving issues involving goods that are lost, damaged or incorrectly delivered before that point.
8. Delivery Dates and Delays
We make every reasonable effort to deliver orders within the agreed timeframe.
Delivery dates and times are estimates unless expressly confirmed as binding.
Occasionally, deliveries may be affected by weather conditions, road closures, vehicle breakdowns, courier delays or circumstances outside our reasonable control.
If a delivery is delayed, we will communicate with the customer and arrange an appropriate solution.
Nothing in these terms limits statutory rights relating to late or failed delivery.
9. Firewood Quality and Storage
We aim to supply firewood that meets the description and specifications provided on our product pages.
Firewood should be stored in a dry, sheltered and well-ventilated location.
Customers are responsible for suitable storage following delivery.
Natural variations in log shape, bark, colour and grain are to be expected.
Where a product is advertised with a particular moisture content, species, length or other specification, it will be supplied in accordance with that description and applicable standards.
10. Returns and Collection Charges
Returns, cancellations and refunds are governed by our separate Refund & Returns Policy and applicable UK consumer legislation.
For change-of-mind returns of loose firewood loads, Hogs Back Logs offers a collection service at a charge of £50 per collection, subject to suitable access and collection arrangements.
This charge applies only where legally permitted, properly disclosed before purchase and agreed with the customer.
Customers may alternatively arrange a suitable return themselves.
Where appropriate, Hogs Back Logs may offer a replacement, alternative product or other mutually agreed arrangement.
No collection charge will apply where Hogs Back Logs is legally responsible for collecting faulty, damaged, incorrect or misdescribed goods at its own expense.
11. Customer Responsibilities
Customers are responsible for:
-
Providing accurate contact and delivery details.
-
Informing us of relevant access restrictions.
-
Ensuring a safe and suitable delivery location is available.
-
Following applicable delivery instructions.
-
Moving and storing goods appropriately after delivery.
These responsibilities do not remove Hogs Back Logs' obligations under consumer law.
12. Complaints and Customer Service
If you experience a problem with your order, please contact us with your order details.
We aim to investigate concerns fairly and resolve them as quickly as reasonably possible.
13. Liability and Statutory Rights
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
Nothing affects the statutory rights of consumers under the Consumer Rights Act 2015 or other applicable consumer legislation.
14. Governing Law
These terms are governed by the laws of England and Wales, subject to mandatory consumer protections that may apply.
